These general conditions govern the use of this site https://www.helenelachapelle.com. This site is owned and managed by Hélène Lachapelle.
By using this site, you indicate that you have read and understood the terms of use and that you agree to comply with them at all times.

We kindly ask you to carefully read the following terms and conditions, as they bind you to the Merchant, the owner of the Site. Additionally, you agree to electronic communication with the Merchant for all your exchanges and that these meet all the requirements of written communication.
We reserve the sole discretion to refuse to serve you, cancel an order, close your account, delete or modify the content of the Site, or cancel an order, whether you have complied with these Terms and Conditions or not.

The products and services offered are intended to be sold to adults who have reached the age of majority in your place of residence, which is 18 years in the province of Quebec. By using the Merchant's Site, you represent and warrant that you have reached the age of majority in your place of residence.
Accuracy of Information
We do our best to ensure that all information published on our Site is free of errors, but we cannot guarantee this. We may refuse or cancel an order containing an item with an incorrect description or price. Unless otherwise stated, prices are in Canadian currency.
The products offered on our Site as well as the dates of offers, prices, and availability, characteristics, and technical specifications of these products are subject to review and change without notice. It is possible that a product ordered online is no longer available in our inventory or cannot be delivered due to a situation beyond our control. We will then cancel the order and refund the amounts paid if applicable.
Your sole remedy in case of non-conformity of a product description is to return it in its original packaging for a refund, in accordance with the refund provisions that apply below.

When you provide us with your payment information, you confirm that you have authorized the use and access to the payment method you have chosen to use.
If we believe that your payment violates a law or one of our terms of use, we reserve the right to cancel your transaction.
Order Errors
If you believe an error has occurred when placing an order, please notify us immediately, but no later than forty-eight (48) hours after discovering it, by sending us a message at info@helenelachapelleart.com and detailing the error made.
Shipping and Delivery
Shipping is free throughout Quebec. Elsewhere in Canada, the United States, and internationally, fees will be calculated by the artist based on the weight and dimensions of the work. This information will be communicated to you before shipment for your approval.
The delivery method, the name of the carrier, and the delivery time will be determined and communicated to you by the Merchant.
We commit to delivering your purchases within a reasonable time subject to the availability of the carriers used by the sender, who are solely responsible for the delivery of the purchased products.
The risk of loss and the ownership right of the purchased goods are transferred to you when it is handed over to the carrier or, if the merchandise crosses an international border, this risk is transferred to you after customs clearance.
When you make a purchase on our site, you agree and acknowledge that you will provide a valid email and shipping address for the order. We reserve the right to modify, reject, or cancel your order whenever necessary. If we cancel your order and have already processed your payment, we will refund you the amount you paid. You agree that it is your responsibility to monitor your payment method. Although we aim to provide an accurate estimate of shipping times and costs, these may vary due to unforeseen circumstances.
Cancellation, Termination, Return, or Refund Policy
You can cancel an order for a good that does not suit you. In this case, you must inform us of the issue that prompts you to cancel the order within forty-eight (48) hours of its discovery by sending us a message at info@helenelachapelleart.com and obtain prior consent for the order cancellation.
You can request a refund for a good that does not suit you. In this case, you must inform us of the issue affecting your product within forty-eight (48) hours of receiving it and obtain prior authorization for the refund. You must then, if required by the Merchant, ship the good as follows:
Returns can be made in person, by appointment, at the following location:

For returns by mail, please pack the products to be returned carefully and make sure to use the original packaging.
We do not cover return shipping costs.
In all cases where a return of goods is required by the Merchant, the ownership right of the returned goods is only transferred to them when it is received at their physical business location.
Warranties
Limitation of liability: Once the artwork is received and accepted, the artist is no longer responsible for damages caused by the handling of the item, its installation, storage location, and storage temperature.
Hélène Lachapelle will be liable for any problem arising from this site. However, Hélène Lachapelle will not be liable for any problem arising from any irregular use of this site.
Indemnity
As a user, you indemnify Hélène Lachapelle from any liability, cost, cause of action, damage, or expense arising from your use of this site or your violation of any provision stated in this document.
Applicable Laws
This document is subject to the applicable laws of Canada and aims to comply with its necessary rules and regulations.
